Domain Services Terms

These Domain Services Terms (“Domain Terms”) apply when you buy, renew, or manage a domain name through here.now. They supplement the here.now Terms of Service. “here.now”, “we”, and “us” mean Beanstalk AI, Inc., a Delaware corporation doing business as here.now. If these Domain Terms conflict with the Terms of Service on a domain-specific point, these Domain Terms control.

1. What we provide

here.now resells domain name registrations. The registrations are provided by name.com, an ICANN-accredited registrar operated by Identity Digital Inc. (“name.com”), under name.com's Registration Agreement, which you accept by purchasing a domain through here.now. ICANN's Registrants' Benefits and Responsibilities also apply.

We are not a registrar. We handle purchase, DNS configuration, renewal billing, and connection to your here.now Sites. The registry for each top-level domain and name.com set the rules for what can be registered and for how long.

2. Ownership and the registrant of record

To let your domain work the moment it is registered, without a verification email you did not ask for, here.now is listed as the registrant, administrative, technical, and billing contact on domains bought through here.now, and WHOIS privacy is enabled where the top-level domain allows it.

You are the beneficial owner of the domain. That means:

You decide what the domain points to, whether it renews, and whether it moves elsewhere.
We hold the registration on your behalf and will not use it for any purpose other than serving your account.
You can transfer the domain to any registrar at any time after the 60-day lock that ICANN requires following registration, at no charge from us, using the authorization code we provide on request (Section 6).
If you close your account or stop paying for the domain, Section 5 applies.

Because we are the registrant of record, legal notices about the domain (for example trademark complaints) reach us first. We will forward them to the email on your account and may act on them as Section 8 describes.

3. Buying a domain

Prices are shown before purchase, in US dollars. We currently charge the registrar's price with no markup; whatever price is shown before you confirm is the price you pay. Registration prices for some top-level domains are promotional for the first term; the renewal price is shown alongside and is what you will pay after the first term.
A purchase is complete when the registrar confirms it. If the registrar rejects the registration, you are not charged (an authorization on your card may appear briefly).
All domain purchases and renewals are final and non-refundable once the registrar has completed them. Registrations are held at the registry and cannot be returned.
You confirm that the domain name you choose does not infringe anyone else's rights and that the information on your account is accurate.
Some names are “premium” and priced by the registry. We show the exact price and require explicit confirmation of it before buying.
We may limit the number of domains an account can buy in a period, and may decline any purchase, to prevent fraud.

4. Renewals and payment

Domains renew automatically about 30 days before they expire, using the payment method on your account, at the renewal price shown in your dashboard at that time. You can turn automatic renewal off for any domain in the dashboard or through the API.
We email you when a renewal succeeds, when a renewal charge fails, and when a domain expires. If a renewal charge fails we retry; if it keeps failing the domain will expire.
If automatic renewal is off, the domain expires at the end of its term and your site stops serving on it.
Renewal prices can change if the registry or registrar changes its price. We show the current renewal price in your dashboard and in the reminder we send before we charge.

5. Expiry

When a domain expires, it stops resolving. For most top-level domains there is a grace period of roughly 25 days during which we can still renew it at the normal price if you update your payment method; we keep retrying during that time. The exact window depends on the top-level domain.
After the grace period the registration ends. The name may become available for anyone to register. We disconnect it from your here.now Sites so that a name that is no longer yours cannot route traffic to your content.
We do not offer registry “redemption” recovery after the grace period.

6. Transferring a domain away from here.now

You may transfer a domain to another registrar at any time after the 60-day lock that ICANN requires following a new registration (and following certain contact changes).
Request the authorization code from your dashboard or through the API. We unlock the domain and provide the code, and we email the account owner every time a code is issued. There is no fee from us; the receiving registrar sets its own price, which usually includes a one-year renewal.
When the transfer completes, the domain is disconnected from here.now and its renewals with us stop. Charges already made are not refunded.
Transfers into here.now from another registrar are not offered at this time.

7. DNS

We configure the DNS records the domain needs to serve your here.now Sites and manage them for you. You may add mail and verification records (for example MX, TXT, SRV, CAA) through the API. Records that here.now relies on to serve your site cannot be removed while the domain is connected. We do not provide email, hosting outside of here.now, or a general-purpose DNS service for these domains.

8. Suspension, abuse, and disputes

Domains bought through here.now are subject to the here.now Terms of Service acceptable-use rules, name.com's policies, ICANN policies (including the Uniform Domain-Name Dispute Resolution Policy), and registry rules. We may suspend or disconnect a domain, or decline to renew it, for violations of any of these, for non-payment, or when required by law, a court, the registrar, or the registry.
If a third party makes a claim about a domain (for example a trademark dispute), we will notify you at your account email and may need your cooperation to respond. Because we are the registrant of record, we may be required to take action on the domain, including transferring or cancelling it, to comply with a decision under the UDRP or a court order.
If your account is terminated, you may request a transfer of your domains to another registrar within 30 days, subject to the 60-day lock. After that we may let the domains expire.

9. Information we share with the registrar

To register a domain we provide name.com with the domain name, our contact information as registrant of record, and payment from our own account. We provide your account email to name.com only where a top-level domain or policy requires an end-user contact. name.com processes this information as an independent controller under its own privacy policy. 10. Liability

Domain registration depends on registries, the registrar, and DNS infrastructure we do not control. To the extent permitted by law, here.now is not liable for registry or registrar outages, for a name becoming unavailable between quote and purchase, for the consequences of an expired or transferred domain, or for third-party claims about a name you chose. The limitation of liability in the here.now Terms of Service applies to domain services, and our total liability for domain services is limited to the amounts you paid us for the affected domain in the twelve months before the claim.

11. Changes

We may update these Domain Terms. Material changes will be announced in the dashboard or by email at least 30 days before they take effect for existing domains, except where a change is required by the registrar, a registry, or ICANN.
